Oregon Child Pornography Laws

In Oregon, there are numerous laws concerning child pornography. These include:

  • Encouraging child sexual abuse, first degree: This law prohibits the creation and distribution of sexually explicit content involving a child. You may not develop, duplicate, publish, exchange, sell, or otherwise disseminate this kind of content. Possession with the intent to do so is also prohibited. This law also prohibits you from possessing or viewing this content with the intent to distribute it. The offender is aware that the creation of the material involved child abuse.
  • Encouraging child sexual abuse, second/third degree: These laws prohibit the possession, viewing, and purchase of sexually explicit content involving a child, without intent to sell or distribute. This is also a measure 11 crime punishable by 70 months in prison.
  • Possession of materials depicting sexually explicit conduct of a child, first/second degree: These laws prohibit the possession or viewing of sexually explicit content involving a child. If you use the content to make a child engage in sexual activities, you will be charged in the first degree; if you only intended to use the content to make a child engage in sexual activities, you will be charged in the second degree.
